This website is an advertising service for third party suppliers, such as hotels, pensions, apartments, and travel agencies. What this means is that the contract for the accommodation is between you and the accommodation supplier. As your contract is not with ABAKA.com we never collect any payments from you and we have no contractual liability to you in respect of this accommodation. However, we may still be liable to you if we have been negligent or have we have knowingly misrepresented important information. The payment will be collected by the hotel - see below section "Hotel Information" Because the contract for the accommodation is between you and the supplier any queries or concerns relating to the accommodation should be addressed to them. Name and address is shown on top of the web booking form and in any confirmatory e-mail we send you. You can also contact the hotel by simply replying to your confirmation e-mail. We will of course also gladly assist you with any general queries or with contacting the hotel, if you wish - please write to feedback@abaka.com.

Personal details and security

You undertake to us that the personal details you give to us are correct and that the credit or debit card you are using is your own. This information is transmitted securely to our secure server where it is also stored. The server uses SSL technology to keep other people from seeing the information you are sending us. Unless we have your express consent we will only disclose personal data to the accommodation provider. This is of course subject to the provision that we may disclose your data to certain permitted third parties, such as members of our own group, our own professional advisers who are bound by confidentiality codes, and when we are legally obliged to disclose your data. With the exception of the credit card information the details of your booking will be transmitted to you and the accommodation supplier by e-mail. Credit card information will not be transmitted by e-mail and will be stored on the secure server. The secure server is hired from pair.com and is physically located in the United States of America. By submitting you personal information through our website you consent to collection, storage and processing of your personal information on this server.

We do not sell, rent or trade your personal information to third parties for marketing purposes nor will we send you any unwanted marketing information.

Hotel information

Unless stated otherwise, the accommodation supplier will not charge you for the accommodation in advance. The charge will be collected during your stay at the hotel, pension or apartment either in cash or by credit or debit card (if accepted by the hotel). The credit card information is only required as a reservation guarantee and the hotel reserves the right to charge you card in case of late cancellation or "no-show" i.e. if you do not arrive to the hotel, pension or apartment at the stated arrival date. Please read hotel's own cancellation conditions for details of the cancellation and "no-show" charges. Unless stated otherwise the charge for no-show is equivalent to one night stay at the hotel, pension or apartment you have reserved. Advertised prices in hotels are on per room, per night basis and include VAT unless otherwise stated. In many cases price may include other services such as breakfast or parking. However, please note that some hotels in other countries may also charge local or other taxes, which may not be included in the offer.

Star ratings may differ according to the country where the hotel is located and therefore we cannot be held responsible for any misconceptions relating to star ratings. Each hotel presentation page includes a pricelist in either CZK o EUR currency. This base currency in which the prices are set by the accommodation provider is clearly stated below the pricelist table. Any conversions from this base currency to other currencies shown on our website are based on mid-rate published by Czech National Bank and are for guidance only. Please be aware any subsequent conversion of the base currency to other currencies may differ from converted guidance price advertised on our website.

Omissions and errors

We will do our best to ensure all information on properties is accurate and up to date. We will correct errors and omissions as quickly as practicable after being notified of them. Reasonable care has been taken that the content of this web site is correct but it is subject to amendment at any time without notice. All content on this web site is published in good faith but you acknowledge that we cannot check the accuracy of all information provided by its suppliers. For example, very occasionally, this may result in a price, product or service or other detail displayed or presented on our website being incorrect (e.g. price given as 100 CZK instead of correct 100 EUR). In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.

We will not be liable for any delay or failure in performance of our obligations which results from any circumstance which is beyond our control directly or indirectly i.e. act of God, war, terrorism, fire, flood, lightening, explosion, fog, sickness, pilferage, machinery breakdown, interruption of utility service, renovations undertaken by the hotel, or worker's strikes.

We shall not be liable for injury, damage, loss, accident, expense incurred by you as a result of any acts or defaults by any hotel or supplier.

Miscellaneous

You must not use the website for speculative, false or fraudulent bookings.

Any part of our website may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you, except if you wish to make copies of the website for your own personal and non-commercial use.
